Third-Party Liability

Third-party liability (RC, "responsabilità civile") insurance for pleasure craft covers damage your boat may cause to others while under way: other vessels, people in the water, jetties and harbour facilities. It is the basic cover for anyone going to sea and, in most cases, is required by law.

When it is compulsory

The Italian Pleasure Boating Code (Codice della nautica da diporto, Article 41 of Legislative Decree (D.Lgs.) 171/2005) refers to the rules of the Italian Private Insurance Code (Codice delle assicurazioni private, D.Lgs. 209/2005, Article 123). In short:

• motorised pleasure craft, including small craft ("natanti"), may not sail in public waters without third-party liability cover;
• the obligation also applies to outboard engines of any power, regardless of the craft they are fitted to;
• only rowing boats and sailing boats without an auxiliary engine are exempt, although liability cover is still advisable for them;
• for craft used commercially (charter with or without crew), the policy must also cover injury to the skipper and passengers.

What it covers and which options to consider

• injury and damage to third parties and their property caused by the craft;
• extension to injury suffered by passengers;
• extensions for towing water-skiers or equipment, where the contract provides for them;
• limits of indemnity above the legal minimums;
• additional cover such as assistance at sea, legal expenses and personal accident cover for the skipper.
