The Spanish flag is very popular with those who sail in the Balearics and along the Iberian coast. Agenzia Magnum helps you register your boat in the Spanish register, for private use or for charter.

Who runs the register

Boats are entered in the Registro de Matrícula de Buques, under the authority of the Dirección General de la Marina Mercante of the Spanish Ministry of Transport. The application is submitted to the maritime district of the port of registry chosen by the owner. Official information is available on the Ministerio de Transportes website.

Who can register

• individuals and legal entities resident or domiciled in Spain or in another European Economic Area state; the latter must appoint a representative in Spain;
• for non-commercial pleasure use the law does not require residence: appointing a representative in Spain is sufficient.

Which vessels

Pleasure boats between 2.5 and 24 metres are governed by Royal Decree (Real Decreto) 1435/2010 and are entered in the seventh list (lista séptima) if used for non-profit leisure, or in the sixth list (lista sexta) if used commercially, such as for charter, provided they carry no more than 12 passengers. Vessels over 24 metres follow Real Decreto 1027/1989 and, for yachts carrying up to 12 passengers, Real Decreto 804/2014.

Advantages for an Italian owner

• an EU flag available to non-residents for private pleasure use;
• a dedicated list (the sixth list) for commercial use;
• port of registry chosen by the owner.

The documents include proof of payment of, non-liability for, or exemption from the special tax on certain means of transport: this should be checked with an adviser before starting the application. The flag does not change the VAT and customs status of the vessel.
