Registration and Discharge of Mortgages

Boats and pleasure ships entered in the Italian registers can be pledged as security through a ship mortgage (ipoteca navale), for example against a loan. For the security to be enforceable against third parties, the mortgage must be made public in the register; likewise, once the debt has been repaid, its discharge must be requested.

The relevant register

Under the central online system for pleasure boating established by Presidential Decree (D.P.R.) no. 152/2018, pleasure craft are entered in the central online pleasure craft archive (ATCN, Archivio telematico centrale delle unità da diporto), which has replaced the registers formerly kept by Harbour Offices and Motor Vehicle Offices. Formalities are carried out through the boat registration desk (STED, Sportello telematico del diportista).

Registering a mortgage

• the mortgage is created by a written deed, public or private, that precisely identifies the vessel (art. 565 of the Italian Navigation Code, Codice della navigazione); for registration purposes the deed is normally drawn up or authenticated by a notary
• the deed is transcribed in the register in which the vessel is entered and noted on the vessel's documents

Discharging a mortgage

Once the loan has been repaid, discharge normally requires the creditor's consent in authenticated form, or a court order. We take care of the filing and of updating the vessel's position in the register.
