A marine incident, such as a collision, a grounding, damage at the mooring, a fire or an injury on board, calls for quick and orderly action: obligations towards the authorities and the insurer have strict deadlines, and the evidence gathered in the first few days affects the outcome of the claim.
Article 60 of the Italian Pleasure Boating Code (Codice della nautica da diporto) requires the master of the vessel to report any extraordinary event that occurs while under way or at rest to the maritime authority, or to the consular authority if abroad, within three days of arriving in port. The deadline is reduced to twenty-four hours if the event affected anyone's physical safety or the environment. The current text is available on Normattiva.
We are not lawyers: when a claim involves disputed liability, significant compensation claims or court proceedings, we bring in lawyers specialising in maritime law and hand them a complete file. We continue to look after the paperwork and dealings with the authorities.
